5. Returns and Exchanges

• ReturnsThe items purchased during the "Happy Hour 2025 10th Anniversary" accepts returns under the brand's normal conditions. The return will be made either as a credit balance in the customer's Popa online account through a voucher/coupon or as a refund of the amount. Except for defective products. Consequences of withdrawal:

In case of withdrawal on your part, we will refund all payments received from you, including delivery costs (except for additional costs resulting from the Customer's choice of a delivery method different from that offered by the supplier). We will proceed to make this refund within 14 calendar days using the same payment method you used for the initial transaction, but please note that we will withhold this amount until we have received the goods.

   During the contest period, Popa Footwear. S.L will randomly insert 11 "Golden Ticket" tickets into orders placed in our online store. The winners of this ticket will have the right to a full refund of their purchase, subject to the conditions detailed in these rules.

   The contest will be active from November 11, 2024 until November 17, 2024. Orders placed outside this period will not be considered for the contest.
4. Requirements to Participate

POPA FOOTWEAR, S.L, hereinafter POPA, will hold a DRAW among Instagram users (@popa_es) who complete the necessary steps to participate. A DRAW that will be conducted in accordance with these terms.   

1.- DurationThe validity date of the DRAW period will begin on the day October 16, 2024 and will end October 21, 2024 at the 12:00 hours (Hereinafter, "Promotional Period"). If due to force majeure it is necessary to postpone or modify the DRAW, this fact will be published on the same profile where it is held to notify the participants.  

2.- PurposeThe DRAW aims to give away three prizes to three different winners:

3.- Participation requirements and mechanics: During the indicated promotional period, all persons over 18 years of age who meet all the requirements to participate will have the opportunity to enter this DRAW. Employees of any of the brand, as well as those who have participated directly or indirectly in the preparation and/or development of it, and their first-degree relatives, may not be winners of the DRAW. The draw will be at the National level (Spain).  

To be able to participate in the DRAW, it will be necessary:

Among all the participants, there will be 3 winners.

There will be 3 winners  of the DRAW in total, who may renounce the prize won, however, under no circumstances may exchange it for a different one. The winner will be contacted by the brands via Instagram. In that message, the express acceptance of the prize and the rest of the data that may be necessary to carry out the effective delivery of the prize will be requested. In case the winner does not send the requested information within 48 hours by email from the sending of the message that declared them the winner and requested such information, POPA may transfer it to the alternate (1 substitute). Likewise, POPA reserves the right to delay the delivery of the prize, due to causes beyond its control, or to change the prize offered for another of identical or similar value due to force majeure.

The making of the payment on account or the application of the appropriate withholding of the Personal Income Tax (hereinafter IRPF).  

In accordance with the aforementioned regulations, participants in this promotion are informed that prizes awarded for participation in games, contests, raffles, lotteries, or random combinations linked to the sale or promotion of goods or services are subject to withholding or payment on account of IRPF provided that the value of the prize (including Value Added Tax) exceeds 600 Euros.  

In relation to the above and in compliance with current tax regulations, POPA, S.L. will apply the corresponding withholding and payment on account on the prize awarded and, at the appropriate time, will issue the relevant certificate to assist the participant in fulfilling their tax obligations by having to include in their personal income tax return the income consisting of the prize received, along with the rest of the income they receive, and from the total tax due, the amount stated in the aforementioned payment on account certificate may be deducted as already paid.  

The winning participant must confirm their personal data on the day the prize is awarded, as well as show their ID card or Resident Card. In order for the withholdings mentioned in the previous point to be made, the winner must in any case sign a written acknowledgment of receipt of the prize upon receiving it and provide a photocopy of their ID card. Once the winning reel has been chosen, Popa Brand will contact the awarded person through their social media profile. If they are unable to contact the winners within five days, the jury may choose the semifinalists in both cases, and if they cannot contact these second winners within five days, that prize will remain unawarded..

5. 5. JURY AND EVALUATION CRITERIA

- The jury will be composed of the Marketing, Design, and Photography teams.

- The following aspects will be taken into account:

• The videos must be original, unpublished, and owned by the author to whom the account belongs.
• Offensive videos or those that infringe on the rights of third parties will not be allowed.
• The overall appeal of the video will be evaluated, both in form and content, taking into account aspects such as its originality, creativity, clarity, and interest of the message.

- The jury is responsible for the interpretation of these rules, as well as for resolving any unforeseen issues not covered by them.

- The jury reserves the right to declare any of the prizes void if there are not enough participants, or if the theme and/or quality of the reels does not meet the contest objectives.

- The jury's decision will be final.

6. WINNING REELS SELECTION.

    The deadline for video submissions is May 31, 2023, at 11:59 PM. Once the deadline has passed, the jury will be responsible for selecting the winning reels according to the specified criteria.

    The jury's decision will be announced on June 5, 2023, through the social media of @popa_es   

 Popa Brand (@popa_es) will tag the winning store/person and will contact them to manage the prize.

    If any of the winners do not meet the participation requirements, they will lose their right to claim the prize won.

7. ACCEPTANCE OF THE CONTEST RULES.

    Participation implies the express consent of the participants to the processing of their data by Popa Brand, to use their username for communications, as well as to display their works, in order to pursue the objectives of the contest.

    The organization reserves the right to resolve, as it deems appropriate, any situation not foreseen in these rules, as well as to make possible changes to dates or deadlines as a result of the current health situation.

   Participants will be responsible for any claims that may arise, or that third parties may make, regarding the originality, similarities, or partial copies of the awarded reels.

8. DATA PROTECTION.

    As established in article 13.1 of the LOPD, the processing of data of individuals over fourteen years old may proceed with their consent, except in cases where the Law requires the assistance of holders of parental authority or guardianship for its provision.

    The indication of the personal data of the winning individuals will be mandatory for the management of the prize. Any false communication of personal data will entitle the organization to disqualify the winner from participating and to withhold the corresponding prize.

    The organization guarantees full compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons (GDPR) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights regarding the processing of personal data collected in this contest.
